1. Acceptance of Terms
By accessing or using Deploy (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. Deploy is a software remediation and App Store compliance service operated by Deploy Inc.
2. Description of Service
Deploy provides expert-level code audit, remediation, and App Store packaging services for AI-generated mobile applications. We review source code line by line, patch critical rejection triggers, and deliver a signed, App Store-ready archive. We do not guarantee App Store approval by Apple Inc., but we do guarantee that our deliverable meets Apple’s published technical requirements at the time of delivery.
3. User Obligations
You represent and warrant that you own or have the legal right to submit all source code, assets, and materials uploaded to the Service. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
4. Data Retention Policy
Source Code Deletion Guarantee
All uploaded user source code is automatically and permanently deleted from our servers 14 days after App Store approval is confirmed. You may also request immediate deletion at any time by contacting support. We retain project metadata (app name, bundle ID, timestamps) for billing and legal compliance purposes only.
5. 48-Hour SLA Guarantee
Scope of Guarantee
The 48-Hour Turnaround Guarantee applies strictly to our initial code remediation and delivery package. This means we guarantee to audit, fix, and deliver your App Store-ready codebase within 48 hours of submission and confirmed payment.
Important exclusion: This guarantee does not cover Apple’s internal App Store review and approval times. Apple’s review process is independent of Deploy and varies based on their internal queue, app complexity, and external factors. We support you through resubmissions, but we cannot control or guarantee Apple’s response timeline.
If we fail to deliver the initial remediation package within 48 hours, you are entitled to a 100% automatic refund of the service fee. Refund requests must be initiated within 14 days of the missed deadline.
6. Payment & Billing
All fees are payable in advance via Stripe. Prices are displayed in USD and are exclusive of applicable taxes. By completing checkout, you authorize us to charge the selected payment method. Subscription or recurring charges, if applicable, will be clearly disclosed at the point of sale.
7. Intellectual Property
You retain full ownership of all intellectual property rights in your original code and assets. Any patches, fixes, or configuration changes we create as part of the remediation process are licensed to you on a perpetual, royalty-free, worldwide basis upon delivery. Deploy retains ownership of its proprietary tooling, audit frameworks, and methodology.
8. Confidentiality & NDA
We treat all uploaded source code and project materials as strictly confidential. Our engineers are bound by confidentiality obligations, and we will sign a mutual non-disclosure agreement upon request. Access to your code is limited to the specific engineers assigned to your project.
9. Limitation of Liability
To the maximum extent permitted by law, Deploy’s total liability shall not exceed the amount you paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or data loss, arising out of or relating to your use of the Service.
10. Termination
Either party may terminate the service relationship at any time. Upon termination, you will lose access to the dashboard and any pending projects may be refunded pro-rata at our discretion. Sections pertaining to data retention, intellectual property, confidentiality, and limitation of liability shall survive termination.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration in Delaware.
12. Changes to Terms
We may update these Terms from time to time. Material changes will be notified via email or through the Service at least 14 days before they take effect. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
